PRIVACY POLICY
This privacy policy (hereinafter referred to as the “Policy”) is issued in compliance with the Federal Law for Protection of Personal Information in Possession of Individuals (hereinafter referred to as the “Law”) and serves to inform current, former, potential, and direct or indirect clients, suppliers, employees, and website visitors (hereinafter collectively referred to as “Data Owners”) about Provimex Business Solutions S.A, de C.V. and its subsidiaries and affiliates (hereinafter collectively referred to as “Provimex Business Solutions”) personal information protection policy.
Provimex Business Solutions, located at Calzada Lomas del Molino 402-J6, Col El Molino, Leon Guanajuato, Mexico, 37138, is responsible for the processing of personal information received from any Data Owner.
As defined in paragraph V of article 3 of the Law, personal information encompasses any data concerning an identified or identifiable individual. For the purposes of this Policy, any information pertaining to a Data Owner received by Provimex Business Solutions through printed, digital, audible, or visual means, whether remote or local electronic and/or optical communication, or any other technology, is considered personal information (hereinafter referred to as “Personal Information”). This includes but is not limited to:
- General information of the Data Owner, such as full name, address, phone number, email address, civil status, occupation, place and date of birth, Federal Taxpayer’s Registry number, Population Registration Code, voter’s license number, passport number, and migration status.
- Curriculum vitae of the Data Owner, encompassing education, professional experience, and acknowledgments.
- Information regarding the Data Owner’s areas of expertise, economic interests for a specific position at Provimex Business Solutions, job availability, and positions, authorities, or designations within one or more companies, including powers of attorney granted to act on behalf of a natural person or legal entity.
- Provimex Business Solutions does not collect sensitive personal information of Data Owners. However, should such information be collected, explicit written consent from the Data Owner will be obtained for its processing.
The Personal Information collected by Provimex Business Solutions is used for the following purposes (“Purposes”):
- Facilitating communication between Data Owners and Provimex Business Solutions regarding the services offered by the latter.
- Drafting and finalizing communications and legal documents, including contracts, agreements, meetings of legal entities, and powers of attorney, which may involve transfer of Personal Information to public notaries, authorities, or law firms.
- Preparation of invoices, remittances, or other accounting or tax documents as legally required.
- Reviewing information to assess potential employment opportunities at Provimex Business Solutions or with third parties interested in Data Owners’ profiles, subject to Data Owners’ consent.
- Maintaining communication with Data Owners regarding services rendered by Provimex Business Solutions and assisting in related processes.
By submitting Personal Information to Provimex Business Solutions through any means outlined in this Policy, Data Owners consent to the use of such Personal Information for the aforementioned Purposes, necessary for the provision of advisory, consultancy, business, and commercial management services by Provimex Business Solutions.
The Purposes outlined in this Policy are essential for establishing and maintaining a legal relationship between Data Owners and Provimex Business Solutions. Therefore, refusal by Data Owners to allow processing of their Personal Information in accordance with these Purposes may prevent the establishment of such a relationship.
Data Owners who do not consent to the processing of their Personal Information for any of the Purposes specified in this Policy, including potential transfers of Personal Information to third parties as outlined in paragraphs (b) and (d), must contact the Human Resources Manager of Provimex Business Solutions via email at contact@provimexbs.com. They should submit a formal application as per the procedure outlined in this Policy, specifying the Purposes to which the processing of their Personal Information is denied and acknowledging the consequences of such denial.
Provimex Business Solutions commits to:
- Restricting the processing of Personal Information to the Purposes outlined in this Policy.
- Maintaining strict confidentiality of Personal Information and refraining from transferring it to any party outside Provimex Business Solutions, except as authorized by Law or by the Data Owner.
- Establishing and maintaining administrative, technical, and physical security measures necessary to protect Personal Information against damage, loss, alteration, destruction, unauthorized use, access, or processing.
- Informing third parties to whom Personal Information may be transferred, as applicable, about the existence of this Policy and the Purposes for which Data Owners consented to the processing of their Personal Information.
- Promptly notifying Data Owners of any security breaches during the processing of Personal Information, allowing them to take appropriate measures to protect their rights.
Each Data Owner is entitled to exercise ARCO rights (Access, Rectification, Cancellation, and Opposition) as outlined in Chapter II of the Law, as well as the right to revoke consent and limit the use or disclosure of Personal Information. To exercise these rights, Data Owners must submit an application to Provimex Business Solutions containing the following information:
Name, address, or alternative contact information for communication.
Documents verifying identity or legal representation (if applicable).
Clear and accurate description of the Personal Information on which they wish to exercise their rights and the extent of such rights.
Any additional elements or documents aiding in the identification of their Personal Information.
For requests pertaining to rectification of Personal Information, applicants must also indicate the modifications to be made and provide supporting documentation.
For requests to revoke consent, applicants must specify the reasons for their request and whether they seek full or partial revocation of consent for processing their Personal Information.
Applications must be sent to the Human Resources Manager of Provimex Business Solutions via email at contact@provimexbs.com or by mail to the address provided in the second paragraph of this Policy.
Provimex Business Solutions will respond to applications within twenty business days of receipt. If the application is accepted, the decision will take effect within fifteen days of notification.
This Policy is subject to change at any time, with Provimex Business Solutions reserving the right to modify it as necessary. Any modifications will be published on Provimex Business Solutions’s website (www.provimexbs.com), and it is the responsibility of Data Owners to stay informed of these changes.
Data Owners may file complaints with the Mexican Federal Institute for Access to Information and Protection of Personal Data in the event of non-compliance with the Law. For more information, visit www.ifai.org.mx.
